The website is the property of J. LUKES SAS in whole, as well as all rights attached thereunto. Any reproduction, in whole or in part, is automatically subject to the authorisation of by the owners. However, any hypertext links leading towards the website are authorised without any specific request being necessary. The present General Terms and Conditions of Sale are subject to change, with the terms and conditions applicable being those in force on the website as at the date on which an order is placed.


Contract

To place an order, you must be at least 18 years of age or have parental consent allowing you to place an order on the website.

Acceptance of the terms and conditions


The client hereby acknowledges to have read the special terms and conditions of sale indicated on this screen, at the time of placing the order, and expressly confirms unreserved acceptance thereof.

The present general terms and conditions of sale govern contractual relations between J. LUKES SAS and the client, with both parties unreservedly accepting them. The present general terms and conditions of sale will prevail over all other conditions appearing in any document, notwithstanding prior, express derogation in writing.


Products

Photographs illustrating products are non-contractual. Information appearing on each product description form, as well as the photo, are only given as a guide, and in the event of any errors appearing, under no circumstances whatsoever may the liability of J. LUKES SAS be incurred. J. LUKES SAS hereby undertakes to take all necessary measures in order to remedy errors or omissions as soon as possible after being notified thereof.

Price

Prices displayed on the website are given in euros excluding VAT and including VAT, excluding contribution towards shipping, processing the order and packaging. Products remain the property of J. LUKES SAS until full payment of the invoice.


Order

Automatic registration systems are considered as proof of the nature, content and date of order, and J. LUKES SAS confirms acceptance of an order to the client at the email address indicated by the latter. The sale will only be completed following order confirmation. J. LUKES SAS hereby reserves the right to cancel any order with a client with whom there is a dispute pending pertaining to payment of any previous order. Information indicated by the buyer, at the time of placing the order, will incur the liability of the latter. In the event of any error in the details of the recipient, the seller may not be held liable for non-delivery of the product.


Availability

Orders are accepted in the limit of stock levels available. Our product offers are valid insofar as they are visible on the website.

In the event of non-availability of a product following an order, the client will only be charged for products in stock. The client will be notified by email of delivery of an order in part or cancellation of the order. The client will have 48 working hours (excluding weekends and public holidays) to request cancellation or issue of special terms and conditions of the order by contacting our Customer Service Department at the following address: contact@vintageluk.com. Beyond this period of 48 working hours, and if no request has been made by the client, the partial order will be dispatched from our warehouses.


Delivery and after-sales service


Following order confirmation, J. LUKES SAS hereby undertakes to deliver the order to the address indicated by the client. Upon receipt of the delivery, you should inspect the condition of the package(s) in order to immediately express any reservations with the shipper. In the event of any problem, please indicate "package refused, package damaged, package missing", as appropriate. In the event of nobody being present to accept delivery, a notice of passage will be left in your letter box notifying you of the process to follow to collect your package. Shipping prices are constantly changing and we apologise in advance for any potential increases. Concerning the after-sales service, in order for an exchange to be considered, products must be returned in their original packaging within eight days (a photograph of the damaged product may be requested) failing which, no redress will be possible.


For reasons of availability, an order may be delivered in instalments to the client. The client will, however, pay in only one instalment. If the client wants the order to be delivered in two different places of delivery, two separate orders should be placed, with their corresponding shipping fees.


Cooling-off period


Pursuant to legislative provisions in force, you will have a total of 14 clear days following receipt of the articles, without needing to provide justification, or having to pay any penalty. The cooling-off period may be triggered by sending a message to customer service using the "Contact Us" link and indicating your name and order number. This will only be accepted for products returned in their original condition and in full along with a copy of the invoice in order to facilitate the processing of returns sent to the following address:

In the event of exercising the cooling-off period, J. LUKES SAS is legally bound to repay all amounts paid by the client, without fees, excluding return shipping fees. Repayment should be made within a maximum of 14 days.

Payment

The price invoiced to the client is, aside for any shipping estimate, the price indicated on the order confirmation issued by J. LUKES SAS.

The price of products is payable in full at the time the order is dispatched.

Payment should be made by card with the acronym CB or with PayPal.

Online, CM-CIC p@iement allows you to pay via a Crédit Industriel et Commercial (CIC) secure banking payment server.

You bank card number is sent to the bank servers, and payment is made directly to a bank in a secure environment without going via the store's server.

An order approved by a client will be considered as final only when the banking payment centres have given their approval. In the event of the payment centres refusing payment, the order will be automatically cancelled and the client notified by email. Moreover, J. LUKES SAS hereby reserves the right to refuse any order from a client with whom there is already a dispute.

Disputes

The present contract is governed by French law. J. LUKES SAS may not be held liable for any damages of any nature whatsoever, whether material or immaterial, or corporal, which may result from improper use of the products sold. The liability of J. LUKES SAS will, in all instances, be limited to the order total and may not be incurred for any simple errors or omissions which may occur despite necessary precautions having been taken in the presentation of products. In the event of any difficulties in enforcement of the present contract, the buyer has the option, prior to taking any legal action, to seek an amicable resolution notably using a suitable professional association, consumer association or any other counsel of his choice. It is hereby reiterated that the amicable resolution does not interrupt the "short term" of the legal warranty, not the term of the contractual warranty. It is hereby reiterated as a rule and subject to a Court ruling that respect of the provisions set forth in the present contract pertaining to the contractual warranty suppose that the buyer respect his financial commitments towards the vendor.
For any question to which you are unable to find a response here, please contact us by email on contact@vintageluk.com. Claims or complaints will always be read carefully, and we will always presume the good faith of any person who takes time to justify his/her reasons for discontent. In the event of any dispute, the client should contact the company as a priority in order to attempt to seek an amicable resolution.
Failing this, Paris Commercial Court (France) will hold sole and exclusive jurisdictional competence, whatever the place of delivery and payment method accepted.


Warranty

The website sells old articles. The company may not be held liable as to respect of these articles with European or international standards currently in force.

J. LUKES SAS may not be held liable for any default in respect of regulatory or legislative provisions in force in the country of receipt, with the liability accepted by J. LUKES SAS automatically being limited to the value of the product in question, at the value as at the date of sale and this without any redress against the trademark or company producing the product.
In all instances, the client benefits from the legal warranty for eviction and hidden defects (Art. 1625 et seq. of the Civil Code). Under the condition that the buyer provides proof of the hidden defect, the vendor should legally compensate all consequences (art. 1641 et seq of the civil code); if the buyer refers the matter to the courts, this should be undertaken within a "short timescale" following the discovery of the hidden defect (art. 1648 of the civil code).


Legal information

Indication of nominative information collected for remote sales is necessary with said information being essential for processing and dispatch of orders and invoice issue. Any failure to provide information will lead to orders not being confirmed. Pursuant to the "Data Protection and Freedom of Information Act", processing of nominative information concerning clients has been notified to the National Data Protection and Freedom of Information Commission (CNIL). The client has (article 34 of the law of 6 January 1978) a right to access, amend, change and delete personal data, which can be exercised by contacting J. LUKES SAS. J. LUKES SAS moreover undertakes not to send, either free of charge or in return for payment, contact details of clients to any third party.
